Delhi High Court Sets Aside Dismissal of recovery Commercial Suit

The Delhi High Court recently provided a crucial opportunity for a publishing house to substantiate its claims for unpaid advertising dues. In the matter of Outlook Publishing India Private Limited versus RR Solution, bearing case number RFA(COMM) 233/2025, the Court passed the order on 06th May 2025. The appellate Court set aside an earlier judgment that had dismissed a recovery suit for outstanding payments.

Initially, the Commercial Court dismissed the suit because the Plaintiff submitted only photocopies of the magazines featuring the Defendant’s advertisements. The Commercial court noted that photocopies were legally insufficient to prove the claim. However, the Plaintiff/Appellant appealed, explaining that the original physical magazines were misplaced due to administrative disruptions caused by the COVID-19 pandemic.

During the appellate hearing, the Appellant successfully produced two original print magazines and confirmed that the third advertisement was a digital publication. Recognizing the unprecedented difficulties posed by the pandemic, the Court determined that the publisher should not be unfairly penalized. Consequently, the Court permitted the appellant to submit additional evidence, including the original magazines and corresponding electronic evidence, and remanded the matter to the Commercial Court for further proceedings.
